CFE Urges Senate to Advance the Patent Eligibility Restoration Act

Strong patent protections are essential to preserving America's leadership in innovation, investment, and technological advancement. The Center for a Free Economy (CFE) recently submitted a letter to the U.S. Senate Committee on the Judiciary supporting S. 1546, the "Patent Eligibility Restoration Act of 2025," legislation that would replace court-imposed patent eligibility standards with clear statutory rules established by Congress. CFE argues that the bill would restore greater certainty to U.S. patent law while reaffirming Congress's constitutional authority to define the scope of patent eligibility under Article I, which empowers Congress to promote the progress of science and the useful arts by securing exclusive rights for inventors. A more predictable patent system would encourage private investment, strengthen economic growth, and help ensure the United States remains the world's leading destination for innovation.
